In this article, Japanese Patent Attorney Toru Kano of BrandAgent explains what a prior trademark search in Japan covers, the points most often missed, and how to use the results to decide what to file.

What you will learn

What a prior trademark search is and why it matters in Japan

The five layers of a proper search

Common oversights that lead to refusals

How to turn search results into a filing strategy

What is a prior trademark search?

A prior trademark search checks, before you file, whether an identical or similar mark has already been filed or registered in Japan for the same or similar goods or services.

Japan is a first-to-file country. Rights go to whoever files first, not to whoever used the mark first abroad. Registration in China, Korea, the EU or the US has no effect in Japan, so a Japanese search is needed even for well-established brands.

Why search first: the risks of skipping it

Office Action: the JPO objects to your mark citing an earlier one. You must respond through a Japanese patent attorney, and the process gets longer.

Final refusal: if the objection cannot be overcome, the application is refused and the filing costs are lost. You may have to change the brand and file again.

Delayed market entry: marketplace brand registration, packaging, ads and listings for Japan can all stall while the mark is uncertain.

The five layers of a proper search

Checking only for the exact spelling is the most common reason searches fail. A proper search works through these layers in order.

1. Exact match

Start with identical marks — in the Latin alphabet and in katakana (the Japanese script used for foreign words).

2. Spelling and script variants

This is where most misses happen. Check:

Latin letters, katakana and hiragana versions of the name

Upper/lower case

With or without spaces, hyphens, dots or other symbols

Word order and joining in multi-word names (“A B”, “AB”, “A-B”)

3. Pronunciation (the most important layer)

Japanese examiners compare how marks sound when read in Japanese. A Latin-letter mark is converted into its natural katakana reading, and two marks with different spellings can be found similar if their readings are close. Short names, marks that differ only in the ending, and differences in long vowels or small “tsu” sounds are high-risk. Foreign applicants often miss this because two names that look and sound distinct in English or Chinese can collapse into nearly the same katakana reading.

4. Closeness of goods and services

Different class numbers do not guarantee safety: goods in different classes can still be treated as similar. Conversely, marks in the same class may be low-risk if the specific goods are far apart. Japan uses “similarity group codes” to judge this, and reading this distance correctly is the hardest part of a search.

5. Logos: dominant part and overall impression

For a logo, the examiner may focus on its most prominent part rather than the whole design. A text element inside a logo is also searched and compared on its reading.

Common oversights

Oversight

Why it causes trouble

What to check

“Spelled differently, so it’s safe”

Similarity is judged by sound too

The katakana reading of every variant

“Different class, so it’s safe”

Goods in different classes can be similar

The specific goods/services, not just the class number

Missing a partial match in a composite mark

One element of a longer mark can be the conflict

Each element of combined marks

Logo looks different overall

The dominant part can decide the outcome

The core visual and text elements

Checking registrations only

An earlier pending application can block you too

Pending applications, not just registered marks

Tip for e-commerce sellers

Short invented names of five to seven letters are popular for online brands, but they are also the names most likely to collide with an existing Japanese mark on pronunciation.
