A structural patent, by contrast, covers the shape, arrangement and combination of physical parts. You can often judge infringement objectively by buying the competitor’s product, taking it apart and measuring it.

Because infringement is easier to prove, it is easier to act quickly — for example, by sending a warning, filing an infringement report with an online marketplace, or seeking an injunction.

A Japanese patent owner can also apply to Japan Customs to have infringing goods stopped at import. For companies whose competitors manufacture abroad and ship into Japan, this is a valuable tool.

② Prove your technology to Japanese customers and partners

A patent is granted only after the Japan Patent Office (JPO) examines whether the invention is new and involves an inventive step. The patent is published, so anyone can check the owner, the inventors and the technology.

Japanese companies tend to value objective evidence when choosing suppliers and partners. A Japanese patent is a public record that tells customers, distributors and investors, “this technology is ours, and competitors cannot easily copy it.”

③ Earn income through licensing or assignment

A patent is not only a right to use your invention — it is also a right to let others use it (licensing) and to sell it (assignment).

For overseas companies without their own sales network in Japan, licensing a Japanese patent to a local manufacturer or distributor can be a way to earn royalties in the Japanese market without building a factory or office. A Japanese patent can also be sold if you later withdraw from the market.

④ Stand out from competitors and avoid price wars

A patent lets you show the market that a particular function or structure is available only from you. Customers who value that feature are less likely to switch to a cheaper copy, which helps you avoid price competition.

The existence of a patent also acts as a deterrent. A competitor who knows “this might infringe” will often think twice before launching a similar product, even if no lawsuit is ever filed.

How to bring your invention into Japan

Overseas applicants usually enter Japan through one of the following routes. The quality of this translation directly affects the scope of your Japanese patent, so it should be reviewed by someone who understands both the technology and Japanese patent practice.

After filing, a request for examination must be filed within 3 years of the Japanese filing date; otherwise the application is deemed withdrawn. If you already have an allowed patent in another office, the Patent Prosecution Highway (PPH) can be used to speed up examination in Japan.

A Japanese utility model protects the shape, structure or combination of articles.
