You have no trademark right in Japan until the registration fee is paid and the mark is entered in the register. A pending application can still be useful (for example, some marketplaces accept a pending application for brand programs — check the platform’s current rules), but it cannot be enforced against infringers.

Where does the time go? The three main causes of delay

Cause 1: An Office Action (notice of reasons for refusal)

If the examiner finds a problem — a similar earlier mark, weak distinctiveness, or a mark that could mislead consumers about quality — the JPO issues a notice of reasons for refusal. You then file arguments and/or amendments, and the examiner reviews the case again. This back-and-forth is the single biggest cause of delay.

Cause 2: Problems with classes or the list of goods/services

Vague wording or goods placed in the wrong class must be corrected by amendment. Even when a fix is possible, the extra round adds time. This is a common issue for foreign applicants who copy their home-country list directly: wording accepted in China, Korea or the EU may not be accepted as-is in Japan.

Cause 3: The mark itself is difficult to register

Very short names, words close to generic terms, industry jargon, or descriptive words in a crowded field are more likely to be objected to. These marks need a strategy before filing.

Fast cases vs. slow cases — what is the difference?

Fast cases

Slow cases

A prior search was done before filing

Filed without a search

Classes and goods/services are clear and follow Japanese practice

Vague wording that needs amendment

A distinctive mark

A generic or very short name with many similar earlier marks

The mark and logo are final

Key logo elements resemble existing marks

If you receive an Office Action: how the timeline changes

1. The JPO issues a notice of reasons for refusal (sent to your Japanese attorney).

2. We analyze the objection and what would overcome it, and report to you in English or Chinese.

3. We file arguments and/or an amendment (e.g. deleting conflicting goods).

4. The examiner re-examines the case.

5. If resolved, a decision to register is issued.

The response deadline can be extended if you need more time to decide (an official fee applies). But arguing back is not a guarantee: a poor response can lead to a final refusal, after which you must appeal or refile — costing both time and money. It pays to decide the strategy early. BrandAgent’s fee for an Office Action response is JPY 25,000 (excluding tax, where applicable).

Need it fast?
