This applies to company names, brand names, product names, service names, logos, store names and app names.

The more value the name gains through advertising, social media, reviews and sales, the more unstable your position becomes without a registration. And because trademark rights are territorial, your registration at home does not help you in Japan.

What happens if you do not register?

Problems do not always appear immediately. But there are four main risks.

1. Someone else registers your mark first

Japan is first-to-file. Even if you have used the name for a long time, a third party who files a similar mark first can put you in a difficult position. For overseas brands, the most common cases are resellers, former distributors and squatters who register a brand that is starting to sell well in Japan. “We are already using it” is not enough.

2. You may have to change the brand name

Rebranding means redoing packaging, labels, your Japanese website, social media, marketplace listings and advertising. Beyond the cost, the recognition and reviews you have built up are lost. On marketplaces, a forced name change can also mean losing listing history.

3. You may receive a warning letter

A trademark right covers similar marks used on similar goods/services. If you use a name close to someone’s registered mark, you may receive a warning letter or a platform complaint, and your listings may be taken down. Whether there is actual infringement depends on the facts, but without your own registration you are always on the defensive.

4. It is hard to act against look-alikes

Without a registration, it is difficult to take a firm stand against third parties using similar names. With a Japanese trademark right, you can seek an injunction and damages, and you can use the registration for Amazon Japan Brand Registry and infringement reports on Rakuten and other platforms.

Who should consider registration most?

Brands that will keep using a product or service name in Japan

Businesses spending on advertising in Japan

Sellers on Amazon Japan, Rakuten, Yahoo! Shopping and other platforms

Brands planning to work with Japanese distributors, licensees or franchisees

Brands planning to expand into Japan as part of a multi-country strategy

One-off event names or names used only briefly may be a lower priority. The key question is: will you invest in this name in Japan?

Is a company registration enough?

No. Company registration and trademark registration are separate systems. Company registration concerns the company name as a legal entity; trademark registration protects a brand name in relation to specific goods and services. Even if you set up a Japanese subsidiary under the brand name, that does not give you a trademark right.

Is owning the domain enough?

No. A domain name is like an address on the internet; owning it does not create a trademark right. The same is true of a marketplace store name or a social media account — without a registration, your brand protection is not sufficient.

“We are small, so we don’t need it yet” — true?

Half true, half dangerous. While you are small, disputes may not arise. But changing the name after you have grown costs far more: packaging, recognition, reviews, search rankings, followers and marketplace ratings are all affected.

In fact, squatters tend to target brands just as sales in Japan start to grow. The practical yardstick is not your size, but whether this is a name you intend to grow.

Are there cases where you can skip registration?

It is hard to say registration is ever completely unnecessary, but it can be a lower priority for:

Names used only for a short-term event

Product names you do not plan to use for long

Internal project names that are not used publicly

For any name you will keep using in Japan, it is safest to consider registration early.

The best time to file

Ideally, after deciding the name but before investing seriously in Japan:

Before launching the brand, product or service in Japan

Before launching a Japanese website or starting advertising

Before opening a store on Amazon Japan, Rakuten or other platforms

If you filed at home within the last 6 months, you can claim Paris Convention priority for your Japanese application. If you are filing in many countries, a Madrid designation of Japan is another option, though if the JPO raises an objection, a Japanese patent attorney will be needed to respond.

What to do before filing

Decide which name and/or logo you want to protect

List the goods and services you sell or plan to sell in Japan

Check for earlier conflicting marks in Japan (prior search)

Prepare the applicant’s name and address in the original language and in English

An applicant with no domicile or business office in Japan must file through a Japanese patent attorney.
